Town of Hampton, New Hampshire Right to Know Request (NH RSA 91: A): MARCH 11, 2025, ELECTION AND THE NEW VOTING WORKS ELECTRONIC BALLOT COUNTING DEVICES - 3.14.25
HOW LONG WILL IT TAKE TO PROVIDE THE INFORMATION USED TO VERIFY THE NEW ELECTRONIC BALLOT COUNTING DEVICES AS WELL AS ENSURE BALLOT CHAIN OF CUSTODY AND RECONCILIATION OF THE VOTING TALLIES FOR THE MARCH 2025 ELECTION?
Per RSA 91-
A:4 IV(c) “IV. (a) Each public body or agency shall, upon request for any governmental record reasonably described, make available for inspection and copying any such governmental record within its files when such records are immediately available for such release.(b) If a public body or agency is unable to make a governmental record available for immediate inspection and copying the public body or agency shall, within 5 business days of a request:(1) Make such record available; (2) Deny the request; or (3) Provide a written statement of the time reasonably necessary to determine whether the request shall be granted or denied and the reason for the delay.(c) A public body or agency denying, in whole or part, inspection or copying of any record shall provide a written statement of the specific exemption authorizing the withholding of the record and a brief explanation of how the exemption applies to the record withheld.” Chapter 91-A ACCESS TO GOVERNMENTAL RECORDS AND MEETINGS (state.nh.us)
ITEMS REQUESTED:
1. A copy of the pre-election certification worksheet,
2. A copy of the moderator's post-election worksheet,
3. A copy of the sealed ballot boxes chain-of-custody storage log,
4. A copy of all machine tabulations and/or tallies generated by the six Voting Works electronic ballot counting devices, including all hand count tallies,
5. A copy of the voter checklist used at the March election,
6. Total amount of same day registrations,
7. A copy of the names on the checklist / ballots cast sheet,
8. Total amount of absentee ballot requests,
9. Total amount of returned absentee ballots,
10. Total amount of processed absentee ballots,
11. A photograph of all ballot chain-of-custody labels,
12. The number of ballots, including absentee ballots, ordered for the March 11, 2025, election,
13. Copies of invoices for all ballots, including absentee ballots, used in the March 11, 2025, election,
14. Copies of the invoices for the purchase and servicing of the six Voting Works electronic ballot counting devices,
15. A copy of the Voting Works report mentioned at the October 28, 2024, Board of Selectmen appointment with the town moderator,
16. A reason for the handwritten changes to the Voting Works "Official Tally Report" on town Articles 22 - 39, and
17. Photographs of all containers used to store ballots, including absentee ballots, for the March 11, 2025, election.
