NOTICE OF DECISION - BARNES V. TOWN OF HAMPTON NEW HAMPSHIRE Docket #218-2024-CV-00568

Rockingham Superior Court October 23, 2024, Notice of Decision

(RIGHT-TO-KNOW VIOLATION)

IN SUMMARY

"...Barnes is entitled to photographs of the chain of custody labels and the tamper-proof tape affixed to all forty-seven ballot boxes. Because the information Barnes requests is unique in that it is attached to the ballot boxes that are noy covered under RSA 91-A, the Court believes that her request to "visually inspect" can be adequately complied with by providing photographs of the chain of custody labels and the tape."

"...to the extent Barnes asks this Court to "order the Department of Justice to conduct a complete forensic audit of all materials" relating the Town election, the Court cannot issue such as order... In addition, the Court notes that Barnes has filed a complaint with the Attorney General's office, which has investigated the matter. https://www.lapennaliberta.com/post/nh-department-of-justice-7-30-24-town-of-hampton-alleged-election-official-misconduct-letter

"For forgoing reasons, Barnes' request is GRANTED to the extent that the Town is required to provide Barnes with full images of the chain of custody labels and the tape attached to all forty=seven ballot boxes. Barnes cannot physically inspect the ballot boxes. Barnes' request to order the DOJ to investigate the Town is DENIED. The Town's motion to dismiss is DENIED as MOOT."
